The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 307 and 506/34 of the IPC.

The prosecution case, as per the written report of Shatrughan Singh, dated 17.06.2018, submitted to the S.H.O., Jagdishpur P.S., is to the effect that, on 17.06.2018, four accused persons including the petitioners came and started abusing and assaulting the informant and his brother. It is also alleged that the accused persons snatched gold chain from the informant and Rs. 2600/- from the pocket of the brother of the informant. It is submitted by the learned counsel for the petitioners that the accusation of assault is omnibus and general in nature

Patna High Court Cr.Misc. No.59692 of 2018(2) dt.28-09-2018 2/2 and injuries have been found to be simple in nature. It is further submitted that in the background of land dispute the present accusation has been levelled. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP submits that the petitioners are named in the FIR and the accusation is specific against the petitioners. Considering the nature of injury being found to be simple in nature, coupled with the statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned A.C.J.M.-XI, Bhojpur at Ara, in connection with Jagdishpur P.S. Case No. 232 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J) Amrendra/Deepak/- U T
