Mr.Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 28-08-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
Petitioners apprehend their arrest in connection with Parihar P.S. Case No.85 of 2019 for the offence punishable under Sections 147, 149, 109, 151, 341, 323, 326, 353 of the Indian Penal Code.
The allegation against the petitioners as per the First Information Report is that police received information that due
Patna High Court CR. MISC. No.53389 of 2019(2) dt.28-08-2019 2/3 to land dispute between two groups, they are indulged in fighting at village Parihar. It has also been alleged that on information police force reached to the place of occurrence and one Sushil Kumar Singh and Surajdeo Mahto of one group were gathered in the house of Ram Ekbal Singh in order to grab his land. It has also been alleged that person assembled from the group of Ram Ekbal Singh attacked the police party and created disturbances by preventing the police from discharging their duty and also damaged motorcycle standing near his house. Learned counsel appearing for the petitioners submits that altogether 26 persons have been named in the FIR. Learned counsel further submits that allegation against the petitioners are general and omnibus in nature. Learned counsel further submits that petitioners have got no concern with Ram Ekbal Singh and Surajdeo Mahto, who were allegedly involved in fighting for the piece of land.
After having heard learned counsel for the petitioners as well as learned counsel appearing on behalf of the State and taking into consideration the fact that the allegation against the petitioners are general and omnibus and further petitioners have got no concern with the land in question and with Ram Ekbal Singh and Surajdeo Singh, as such, I am inclined to grant
Patna High Court CR. MISC. No.53389 of 2019(2) dt.28-08-2019 3/3 anticipatory bail to all the petitioners.
Accordingly, all the petitioners, above named, are directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by them, they shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
