Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner submits that the petitioner was granted the privilege of anticipatory bail by an order dated 25-4-2024 in Cr. Misc No. 31030 of 2024. It is next submitted that in terms of the order dated 25-4-2024 in Cr. Misc No. 31030 of 2024, the last date of surrendering before the learned trial court was 6-6-2024. It is next submitted that petitioner surrendered on 6-5-2024, as would manifest from Annexure-2 to the modification application, but since a condition was imposed in the order dated 25-4-2024 in Cr. Misc No. 31030 of 2024 that the criminal antecedent of the petitioner is to be verified, as such the criminal antecedent of the petitioner

Patna High Court CR. MISC. No.62525 of 2024(2) dt.30-08-2024 2/2 was called for and the same was received on 31-5-2024, thereafter the petitioner again appeared before the learned trial court on 6-6-2024, but his application was not taken up and the same was taken up on 7-6-2024. Learned counsel for the petitioner further submits that learned trial court granted the privilege of provisional anticipatory bail and also gave time for seeking modification of the order dated 25-4-2024 in Cr. Misc No. 31030 of 2024.

In view of the submission made by the learned counsel for the petitioner, the learned trial court is directed to confirm the provisional anticipatory bail of the petitioner. 4.

Accordingly, the instant modification application stands allowed.
