The Petitioner who is in custody seeks bail in connection with Patna Rail P.S. Case No. 134 of 2017 registered for the offence punishable under Sections 186, 201, 353, 506, 120B of the Indian Penal Code, Section 66A(a)(b)(c) of the I.T. Act, 2000 and Section 150(e) of the Railway Act 1989 and Section 3(2e) of the Public Property Prevention to Damage Act.
It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR and his name has transpired on his own confession. It has been further submitted that similarly situated co-accused persons have been granted bail by co-ordinate benches of this court vide order dated
Patna High Court Cr.Misc. No.45130 of 2017(2) dt.21-09-2017 2/2 06.07.2017 in Criminal Miscellaneous No. 30972 of 2017, 20.07.2017 in Criminal Miscellaneous No. 34004 of 2017, 10.08.2017 in Criminal Miscellaneous No.38048 of 2017 and 19.08.2017 in Criminal Miscellaneous No. 38599 of 2017. The petitioner has got no criminal antecedent and is in custody since, 19.03.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Patna, in connection with Patna Rail P.S. Case No. 134 of 2017.
