The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 09.05.2014 passed in Cr. Misc. No. 5960 of 2014 on the ground that now the victim has already been examined and in near future the trial is not likely to be concluded. It is submitted that though the victim in the examination-in-chief has stated about rape but during crossexamination she appears not reliable. The learned A.P.P. opposes prayer for bail by submitting that the victim has supported the allegation of rape in the court also.

In the facts and circumstances as stated above, finding

Patna High Court Cr.Misc. No.42276 of 2015 (3) dt.07-01-2016 2/2 no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Sessions Trial No. 533 of 2013 arising out of Bhawanipur P.S. Case No. 137 of 2013 pending in the court of 2nd Additional Sessions Judge, Purnea.

However, the trial court is directed to expedite the trial and to conclude the same as per amended proviso of section 309 Cr. P. C.
