JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 21-09-2016 Heard counsel for the petitioner and the State. There are two issues vexing the petitioner. One relates to payment of his outstanding dues for the work done as Jeep Driver under the Circle Officer, Narkatiaganj and the other is regularization. So far as the dues is concerned, the respondents have stated that petitioner has been paid his claim up till 31.8.2015. Thereafter a demand has been raised for release of fund. No sooner, the allotment is received, petitioner will be paid his rightful dues. The writ application with regard to salary, therefore, stands disposed of with the observation that the District Magistrate, West Champaran at Bettiah will take cognizance of Annexure- B dated 12.9.2015, which is letter no.960, addressed to him by the

Patna High Court CWJC No.17758 of 2014 dt.21-09-2016 2/2 Circle Officer, Narkatiaganj so that the petitioner can be paid his claim, which has not been done for almost a year. Since petitioner is a daily wager, he cannot survive without such payment. The allotment must be released and paid to the petitioner within a period of three months from the date of production of a copy of this order. So far as regularization is concerned, the rules are in place. The claim of the petitioner will be considered in terms of the rules.

The writ stands disposed of with the above direction and observation.
