The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 341, 379, 504, 506 and 509/34 of the Indian Penal Code. It is contended that the petitioners and the informant side are agnates and the allegation of taking out of Rs.800/- and cashew worth Rs.600/- are merely ornamental in nature. It is further contended that the petitioners' are having clean antecedent. Having regard to the facts and circumstances of the case, let the petitioners, namely, Ajay Yadav @ Ajay Kumar Yadav and Rajendra Yadav @ Gajendra Yadav, be released on bail in the event of his arrest/surrender before the court below

Patna High Court Cr.Misc. No.31142 of 2016 (2) dt.08-08-2016 2/2 within a period of six weeks from today in connection with Raghopur P.S. Case No. 49 of 2016, G.R. No. 159 of 2016 on furnishing bail bond of Rs.10,000/- (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Birpur, subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.

However, at the time of furnishing bail bonds, the court below would be required to verify the criminal antecedent of these petitioners and if it found the petitioners involved in any criminal cases before the date of filing of present application i.e. on 25.7.2016, then they would be taken in custody.
