====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-08-2023 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 376/34 of the Indian Penal Code.

3. According to F.I.R., the petitioner is alleged to have demanded Rs. 5 lacs as dowry from the informant in order to let the informant marry to the son of the petitioner who, allegedly, raped and impregnated her.

4. It is submitted that specific accusation of commission of offence punishable under Section 376 IPC is against co-accused Naurej. Petitioner is mother of co-accused Naurej and she is only alleged to have demanded Rs. 5 lacs as dowry. Petitioner is a lady and claims clean antecedent.

5. Considering the facts and circumstances of the

No.56621 of 2023(2) dt.31-08-2023 2/2 case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Court No. VII, Civil Court, Katihar in connection with Falka P. S. Case No. 170 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
