In this case, the petitioner is seeking bail in connection with Govindgunj Mallahi P.S. Case No. 148 of 2014 registered for offence under section 7 of the E.C. Act Allegation has been made that 137 bags of wheat equal to 68 quintal, belong to the State Food Corporation meant for the poor people were found in the house of one Munna Prasad and from there it was recovered and 86 bags of rice equal to 43 quintal have also been recovered from the standing tractor. The counsel for the petitioner has taken defence that the petitioner is a Tractor Driver and he has nothing to do with the grains which were found loaded in the tractor. Whenever and
Patna High Court Cr.Misc. No.41238 of 2014 (2) dt.14-01-2015 2/2 wherever his tractor is hired, he carries the goods of the person to respective destinations. The petitioner, having no criminal antecedent as has been mentioned in paragraph 3 of this application, is in custody since 4th August 2014. Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, East Champaran in connection with Govindgunj Mallahi P.S.
