====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-10-2018 Heard Sri Ajay Kumar Tiwari, learned counsel for the petitioner and Sri Abhay Kumar No. 1, learned Additional Public Prosecutor.

The sole petitioner, having clean antecedent, which fact has been stated in paragraph - 3 of the petition, apprehending his arrest in connection with Sasaram ( M) P.S. Case No. 143 of 2018 , registered for the offence under Section 30(a), 34, 38, 37(b) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

Learned counsel for the petitioner submits that petitioner in the present case has been arrayed as accused only on the ground that he is the owner of the motorcycle. The coaccused -Vikash Choudhary who is friend of the petitioner had

Patna High Court Cr.Misc. No.62206 of 2018(2) dt.08-10-2018 2/2 taken his motorcycle, consumed liquor and while carrying one liter of mahua liquor he was intercepted by the Police and petitioner only being owner of the vehicle has been made accused.

Considering the nature of accusation as well as the fact that petitioner is having clean antecedent, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner - Dadan Kumar Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge -II - cum - Special Judge, Excise, Rohtas at Sasaram / concerned court in connection with Sasaram (M) P.S. Case No. 143 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
