For the State : Mr. Shantanu Kumar, APP ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 17-09-2016 I have heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in a case registered for offences punishable under Sections 420,467,468 and 471 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the informant had willingly transferred the land of his share in favour of Petitioner no. 1 and in fact the police, after investigation and also after making inquiry from the office of Sub-Registrar, has come to the conclusion that willingly the sale deed was executed and registered and the informant had appeared in the office of the

Patna High Court Cr.Misc. No.34396 of 2016 (2) dt.17-09-2016 Registrar and confirmed the execution of the sale deed. Thereafter the police had submitted final form exonerating the petitioner but the Court below had taken cognizance against him. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail in the event of arrest/surrender before the Court below within a period of six weeks from today in Siwan Town P.S. Case No. 184 of 2014, on furnishing bail bond of Rs. 10,000/-(Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan subject to the conditions as laid down under Section (2) of Section 438 of the Code of Criminal Procedure.
