JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 302 and other allied sections of the Indian Penal Code.
As per the prosecution case, two FIR named and four unknown accused persons killed the son of the informant, when he had gone to Tempo stand with his e-rickshaw. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. His name has figured during course of investigation. He submits that e-rickshaw of the deceased was recovered from the possession of co-accused Bihari Singh. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Learned counsel for the State opposes the prayer for bail and submits that during investigation, mobile phone of the deceased was recovered from the house of the petitioner. Considering the nature of accusation and aforesaid recovery of mobile phone from the house of the petitioner, his prayer for bail is refused.
