Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 20.4.2018 passed in Cr. Misc. No.23686 of 2018 with a direction to the petitioner to surrender within a period of four weeks , however, it appears that the petitioner has not surrendered within the time as directed by this Court and now the file for modification has been filed on the ground that he was suffering from illness.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to interfere with the earlier order, however, if the petitioner surrender within a period of four weeks from the date of receipt of the order and pray for regular bail, the learned trial court below shall consider this

Patna High Court Cr.Misc. No.60058 of 2018 (2) dt.03-10-2018 2/2 aspect of the matter that he had been earlier granted anticipatory bail but he could not surrended within the time and his prayer for bail shall be disposed of, if possible on the same day. With the aforesaid modification, this application is disposed of.
