The petitioner seeks bail in a case under Section 420, 379, 411/34 of the Indian Penal Code.

The petitioner is alleged to have taken the ATM card from the informant and withdrew Rs. 28,800/- but on chase the petitioner was apprehended and money was recovered from the possession of the petitioner.

It is submitted that the petitioner has already deposited the amount withdrawn from the account of the informant. The petitioner has got no criminal antecedent and he is in jail for more than four months.

Considering the facts aforesaid and the fact that being the first offender the petitioner has remained in jail for more than four months, the above named petitioner is directed to be enlarged

Patna High Court Cr.Misc. No.44986 of 2015 (2) dt.24-09-2015 2/2 on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Kotwali P.S. Case No. 253/ 2015.
