The petitioners seek regular bail in connection with Madhepura (Bharrahi) P.S. Case No. 823 of 2017 instituted for the offences under Section 30(a) of the Excise Act. The allegation is regarding recovery of 80 litres of illicit liquor from a thatched house which belongs to the petitioner no. 1. The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and the plantation of the illicit liquor cannot be ruled out. It is submitted that the petitioners have a clean antecedent and they are in custody since 29.11.2017.
Considering the nature of accusation, the period of
Patna High Court Cr.Misc. No.1137 of 2018 (2) dt.19-01-2018 2/2 custody already undergone and the fact that the petitioners are having a clean antecedent, I deem it fit and proper to enlarge the petitioners above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Bharrahi) P.S. Case No. 823 of 2017.
