This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioners for restoration of Cr. Misc. No. 11727 of 2018 which was dismissed for noncompliance of the order dated 27.02.2018 passed by this court. It is contended by the learned counsel for the petitioners that since his clerk had fallen ill, the order could not be complied with in time. However, after lapse of only two days, the

Patna High Court Cr.Misc. No.42623 of 2018 (2) dt.26-09-2018 2/2 order has already been complied with.

Considering the facts and circumstances of the case, the application is allowed.

Cr. Misc. No. 11727 of 2018 is directed to be restored to its original file.
