JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-10-2017 The petitioner seeks regular bail in connection with Kuchaikot P.S. Case No. 139 of 2017, registered for offences punishable under Sections 272, 273 and 420 of the Indian Penal Code and Sections 30(a)(b)(c ) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 6422 litres of foreign liquor. It has been submitted on behalf of the petitioner that he is the khalasi of the truck from which the alleged recovery was made and has nothing to do with the seized liquor and he has no criminal antecedent and has been in custody for last four months. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and also that in this case huge quantity

Patna High Court Cr.Misc. No.48386 of 2017 (2) dt.12-10-2017 of liquor has been recovered, as such, this application is disposed of with the direction to the court below to expedite the trial and try to conclude it within a period of six months and if the trial is not concluded within the aforesaid period, the trial court shall release the petitioner to his own satisfaction.
