JUSTICE MADHURESH PRASAD ORAL ORDER 12-01-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State of Bihar. The petitioners seek bail in connection with Ashok Paper Mill (A.P.M.) P.S. Case No. 33 of 2022 registered for the offence punishable under Section 302, 504, 506/34 of the Indian Penal Code (for brevity 'IPC').
Prosecution case, in short, is that the marriage of the informant's daughter namely Mala Devi was solemnized with Rakesh Lal Dev about 10 years ago as per Hindu custom. After marriage accused used to assault informant's daughter for not bringing Rs. 3 lakhs from the parents and also threatened to kill her. Learned counsel for the petitioners submits that petitioners have clean antecedents and they have falsely been implicated in the present case. He further submits that petitioners are in-laws of the
Patna High Court CR. MISC. No.56674 of 2022(2) dt.12-01-2023 2/3 deceased and it appears from the First Information Report (for brevity 'F.I.R.') that there is general and omnibus allegation against the petitioners and the petitioners have no concern at all with the family affairs of the deceased. He further submits that the police after investigation submitted the charge sheet against the petitioners. Petitioner No. 1 & 2 are in custody since 01.06.2022, whereas petitioner No. 3 & 4 are in custody since 12.08.2022. C-accused has been allowed bail in Cr. Misc No. 29267/2022. Learned APP for the State has opposed the prayer for bail. Considering the rival submissions, this Court, for the purposes of grant of bail, is inclined to accept the submissions advanced by the petitioners' counsel. Prayer for bail of the petitioners is allowed.
Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Darbhaga, in connection with Ashok Paper Mill (A.P.M.) P.S. Case No. 33/2022, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.
(ii)That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail bond will be liable to be cancelled.
This Court would expect that the petitioners' counsel would honour his undertaking in the instant proceedings regarding supply of the requisite court fee etc. within two weeks from the date he is called
