The petitioner seeks bail in connection with Phulwarisharif (Janipur) P.S. Case No. 362/2017 dated 14.06.2017 instituted for the offences under Sections 307, 353, 504 and 34 of the Indian Penal Code, Sections 25(1-b)A, 26 and 35 of the Arms Act and Section 37(C) of the Bihar Prohibition and Excise Act, 2016.

The petitioner was found to be in a drunken state on the highway, and creating disturbance for the passers-by. Learned counsel for the petitioner has submitted that nothing has been recovered from his possession, even though in the F.I.R., there is an allegation of firing at the police party. The petitioner is in custody since 16.06.2017. Further,

Patna High Court Cr.Misc. No.57119 of 2017 (2) dt.06-12-2017 2/2 similarly situated another accused, viz. Nagesh Kumar @ Nagendra Kumar has been granted bail by order dated 17.10.2017 passed in Cr. Misc. No. 49908/2017.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna in connection with Phulwarisharif (Janipur) P.S. Case No. 362/2017.
