The petitioner is languishing in custody since 05.07.2014 in a case registered for the offences punishable under Sections 420, 406 of the Indian Penal Code and 7 of Essential Commodities Act.

The accusation is that the petitioner being the PDS dealer misappropriated 39.08 quintals of wheat and 53.62 quintals of rice supplied under Antoyodhya scheme and BPL scheme.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation and the

No.41801 of 2014 (04) dt.03-03-2015 2/2 period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Gopalganj in connection with Phulwariya P.S. Case No. 109 of 2013.
