The petitioner apprehends her arrest in Gwalpara P.S. Case No. 37/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that while he along with others were returning after taking feast at the house of Ex-Mukhiya Abdul Ahmad of village Singarpur the informant saw the road was blocked. When the informant requested to park the vehicle by the side of road the accused persons assaulted the informant and also damaged the vehicle. Shailesh Kumar Singh, his son and brotherin-law are alleged to have dragged the informant and assaulted him.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.32593 of 2016 (4) dt.29-09-2016 2/2 petitioner is the wife of Shailesh Kumar Singh. There is no specific allegation against the petitioner. False case has been filed only to settle the score between the two rival groups. On the other hand learned counsel for the informant as well as learned A.P.P. however, vehemently opposed the prayer for anticipatory bail of the petitioner, but could not be able to show any specific allegation against the petitioner. Considering the facts aforesaid and the fact that petitioner is a lady, the petitioner above-named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Uda-Kishunganj Madhepura in connection with Gwalpara P.S. Case No. 37/2016 G.R. No. 368/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
