Petitioner seeks bail in connection with Sour Bazar P.S. Case No. 259 of 2017 for offences punishable under Section 420 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that the petitioner came and sold Rol gold instead of real gold and took away Rs. 13,800.00 from her. She was found in the market with other Rol gold jewellery and was apprehended. It has been submitted by the learned counsel for the petitioner that she is innocent, bears no criminal history and is languishing in judicial custody since 31.05.2017. He submits that charge-sheet has already been submitted and there is no allegation
Patna High Court Cr.Misc. No.51104 of 2017 (2) dt.08-11-2017 2/2 of tampering of the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record and that the charge-sheet has already been submitted, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar P.S. Case No. 259 of 2017, subject to the condition that one of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating his relationship with the petitioner.
