JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner rather 35.800 liters of illicit made liquor is said to have been recovered from the place of occurrence. After seeing the police party petitioner managed to escape from the place of occurrence. Petitioner has been made accused in this case on the secret information received by the police. He has no concern either with the seized liquor or the place of recovery or any trade of liquor. He has
Patna High Court CR. MISC. No.55916 of 2022(2) dt.18-11-2022 2/2 been falsely implicated in this case at the instance of his enemy. Petitioner has five criminal antecedents of similar nature as mentioned in para-3 of this application.
Having regard to the facts and circumstances of the case, huge recovery of liquor and the criminal antecedents of the petitioner, I am not inclined to enlarge him on anticipatory bail.
The prayer for anticipatory bail of the petitioner is hereby rejected.
