The petitioners are languishing in jail since 11.07.2015 (Cr.Misc.No.43572 of 2015) and 07.09.2015 (Cr.Misc.No.51878 of 2015) in a case instituted under Sections 364/34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.43572 of 2015 (3) dt.30-11-2015 As per prosecution case, it is a case of abduction of informant's son, namely, Mantoo Kumar by the accused persons. It has been submitted on behalf of the petitioners that the petitioners are languishing in jail since 11.07.2015 (Cr.Misc.No.43572 of 2015) and 07.09.2015 (Cr.Misc.No.51878 of 2015) respectively. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioners. Petitioners have got no criminal antecedent. The victim boy is said to have been recovered on the same day within a period of one and half hours. Petitioners have falsely been implicated in the present case. Petitioners and the victims are of the same village and the petitioners have been implicated for oblique reasons.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with K.Hat P.S.Case No.450 of 2015.
