JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-10-2024 The present petition has been filed for modifying the order dated 11.7.2024, passed by this Court in CWJC No. 6765 of 2024, inasmuch as it is the averment of the learned counsel for the petitioner that in the original writ petition itself, it had inadvertently been mentioned, by mistake that the petitioner i.e. Tetra Devi is wife of late Janak Chaurasiya @ Janak Dev Chaurasiya, however, the fact is that the husband of the petitioner is still alive, hence, it is prayed that the prayer portion,
Patna High Court MJC No.2727 of 2024(3) dt.18-10-2024 2/2 reproduced in the said order dated 11.7.2024, be also modified to the extent that the fact mentioned therein regarding her husband death be directed to be expunged.

Considering the submissions made by the learned counsel for the petitioner as also the averments made in the present petition, I deem it fit and proper to direct that as far as the order dated 11.7.2024 is concerned, it would be deemed that the husband of the petitioner, namely, Sri Janak Chaurasiya @ Janak Dev Chaurasiya, is alive.

Accordingly, the present modification petition stands disposed off with the aforesaid modification in the order dated 11.7.2024, passed in CWJC No. 6765 of 2024.
