JUSTICE RAVI RANJAN ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 392 and 364 of the Indian Penal Code.

It is contended that the FIR was lodged against unknown for abduction of three persons alongwith their vehicles. It is further contended that during investigation, name of the petitioner has come on the basis of confessional statement of co-accused Firoz Mian, who has already been granted regular bail vide order dated 9.02.2016 passed in Cr. Misc. No.49757/2015 (Annexure-3). It is claimed that the petitioner's antecedent is clean. Having regard to the facts and circumstances of the case, let the petitioner, namely, Md. Raju Mian @ Raju Qureashi

Patna High Court Cr.Misc. No.34374 of 2016 (2) dt.17-09-2016 2/2 @ Md. Raju Qureashi be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Barachatti (Sherghati) P.S. Case No.37 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Narendra Pal Singh, Judicial Magisitrate, 1st Class, Sherghati, Gaya subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.

However, at the time of accepting bail bond, the court below would verify and assure itself regarding the criminal antecedent of the petitioner. If he is having clean antecedent then his bail bond would be accepted. If he is found to be involved in any other case before 8.06.2016 then he would be taken into custody.
