21-01-2015 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 13.07.2014 in connection with Pothia ( Paharkatta) P.S. Case no.181 of 2012 registered for the offence under Section 304(B)/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner is not having any relation with family of the husband of the deceased. It was further submitted that though the petitioner was named accused in the F.I.R., during investigation the case was not found true against the petitioner and, as such vide Charge Sheet No.57 of 2013 dated 22.08.2013, the petitioner was exonerated and she was not forwarded as accused. However, learned court below differing with the police report has passed
Patna High Court Cr.Misc. No.42435 of 2014 (3) dt.21-01-2015 2/2 order of cognizance.
Keeping in view the fact, particularly the fact that the petitioner was having no relation with the family of husband of the deceased and final report was submitted against her, let the petitioner, Aluna Khatoon @ Aluna @ Asuna Khatoon be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Pothia ( PaharKatta ) P.S.
