In this case, the petitioner is seeking anticipatory bail in connection with Bihta P.S. Case No.695 of 2015, registered for the offence punishable under Section 406 of the Indian Penal Code.

Allegation has been made against the petitioner that he has taken Rs.51, 500/- from the informant for the purposes of boring and construction of the house, but the petitioner has not done anything.

Learned counsel for the petitioner submits that the petitioner is ready to return the amount in two equal installments.

No.28662 of 2016 (2) dt.26-07-2016 2/2 In view of the above statement made by the learned counsel for the petitioner, let the above named petitioner in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Danapur (Patna) in connection with Bihta P.S. Case No.695 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. The petitioner is directed to pay half of the amount to the informant before acceptance of bail bonds and rest amount within a period of one month thereafter. If the petitioner would fail to comply the aforesaid direction, this order will be treated to have been withdrawn.
