The petitioner seeks bail in Harnaut (Gokhulpur) P.S. Case No. 271 of 2017 registered for the offence punishable under Section 366(A) of the Indian Penal Code. Informant is the father of the victim girl, who has stated in his complaint that his daughter Puja Kumari aged about 16 years went to the residence of her maternal uncle on 30.08.2017 and on 31.08.2017 she told her maternal uncle that she is going to market and after that she did not return and thereafter they informed the informant. The informant started searching and after much search she could not be traced and they could learn from secret information that petitioner-Santosh Ravidas had eloped with his daughter. Patna High Court Cr.Misc. No.393 of 2018(2) dt.17-01-2018 2/2 recovered and in her statement under Section 164 of the Cr.P.C had stated that she had gone with the petitioner on her own volition and sweet will. She got married with him and wants to live with him as his wife in her matrimonial home. The petitioner has got no criminal antecedent and is in custody since 04.09.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut (Gokhulpur) P.S. Case No.271 of 2017.
