JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner, learned counsel for the opposite party no. 2 as well as learned Additional Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Jamui Mahila P.S. Case No. 70 of 2018 registered for the offences punishable under Sections 494, 498(A) of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Petitioner happens to be husband of the opposite party no. 2 and it would appear from perusal of the first

Patna High Court CR. MISC. No.56806 of 2019(6) dt.05-03-2020 2/3 information report that he has already solemnized his second marriage. However, a co-ordinate Bench of this court granted provisional bail to petitioner vide order dated 12.09.2019 and subsequently, the matter was referred to Mediation Centre, Patna High Court, Patna but unfortunately, the learned Mediator failed to resolve the dispute of the parties. Since the petitioner has already surrendered before the court below in pursuance of order dated 12.09.2019, this anticipatory bail petition stands disposed of with direction to learned court below to explore the possibility to resolve the dispute of the parties within two months from the date of receipt/production of copy of this order and furthermore, the petitioner as well as opposite party no.

2 are directed to appear before the court below whenever they are summoned by the concerned court. It is made clear that provisional bail of the petitioner is extended for further period of two months from the date of receipt/production of copy of this order before the concerned court.
