2. The petitioner has preferred this application for grant of regular bail in connection with Patliputra P.S. Case No. 189 of 2025 dated 27.04.2025 registered for the offences punishable u/ss 126(2), 127(2), 127(6), 115(2), 140(3), 308(5) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, the informant received a call from his friend Suhail Khan who told him to receive some gift from his girlfriend from Zudio Mall, Bailey Road, which Suhail Khan would collect from the informant after returning to Patna. The informant along with his friend went to the place but did not find any girl but allegedly two boys caught and assaulted

The informant further alleged that all the five boys started beating them and told that the friend of the informant had purchased a motorcycle for Rs. 1,40,000/- out of which 25,000/- was yet to be paid by the friend of the informant and hence the informant and his friend was made to call their father and ask to bring Rs. 25,000/- each, upon which the father of the informant called the police and the informant was rescued. One amongst the five boys accused of committing this offence happens to be the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner rather the specific allegation is against the co-accused persons. It is further submitted that the allegation against the petitioner is general and omnibus in nature. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The co-accused person has already been granted regular bail by the Coordinate Bench of this court vide order dated 12.08.2025 passed in Cr. Misc. No. 53525/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Patliputra P.S. Case No. 189 of 2025, with the condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
