JUSTICE SHIVAJI PANDEY ORAL ORDER 04-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Jalalpur P.S. Case No.91 of 2016, registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and under Section 47 of the Amended Excise Act, 2016.

The police received secret information that the petitioner is selling illegal wine in the closed bricks Chimney of one Kanahaiya Sah. On the basis of the said information, the police party raided the said place. Upon seeing the police party one of the persons fled away, the police party chased him but could not be apprehended, the police party recovered 36 packets of pouche,

Patna High Court Cr.Misc. No.28678 of 2016 (3) dt.04-08-2016 2/2 each containing 200 ml. were found in a plastic bag. The police seized the same and accordingly prepared the seizure list. Learned counsel for the petitioner submits that the petitioner has nothing to do with the closed bricks chimney of Kanahaiya Sah and has falsely been implicated in the present case.

Looking to the nature of allegation and the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. If the petitioner surrenders before the Court below within three weeks from today and prays for bail, the court below will pass order on the same day in accordance with law without being influenced by this order.
