The petitioner seeks bail in connection with Special Case no. 68 of 2017 arising out of Tedhagachh P.S. Case no. 26 of 2017 registered under Sections 272, 273 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act-2016. 15 lts. of Nepali wine is said to have been recovered from the plastic bag tied with the bicycle of the petitioner while the petitioner managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Petitioner has no concern with the seized

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-II-cum-Spl. Judge, Kishanganj in connection with Special Case no. 68 of 2017 Tedhagachh P.S. Case no. 26 of 2017.
