This application for grant of anticipatory bail arises out of Barauni (Chakia) P.S. Case No. 429 of 2015, disclosing offences under Sections 144, 149, 152, 153, 290 and 353 of the Indian Penal Code.
From the First Information Report, it appears that allegedly the public, at large, were protesting against murder of some one and they had blocked movement of traffic on National Highway-31. Upon intervention of the Police, it is alleged that they attacked the Police party, damaged the Police vehicles and injured the members of the Police force. There are 22 persons named in the First Information Report including these petitioners and 200 persons, who are not named.
Patna High Court Cr.Misc. No.32247 of 2016 (2) dt.29-08-2016 2/2 Learned counsel for the petitioners has submitted that there is general, omnibus and vague allegation against all the persons, named in the First Information Report. Learned counsel for the petitioners has also submitted that no injury has been found on the person of any one.
Considering the submission as above, this application is allowed.
Let the petitioners, above-named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakia) P.S. Case No. 429 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
