Petitioners are apprehending arrest in connection with Morkahi P.S. Case No. 97 of 2016 for the offence under sections 341, 323, 379, 504, 506, 406, 420/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioners have no criminal antecedent. He further submits that instant case was registered against the petitioners in connection with non-execution of the sale-deed and breach of promise to execute agreement of sale. Learned counsel submits that instant case was registered after three months. He further submits that earlier in relation to the same, a case was registered against the
Patna High Court Cr.Misc. No.62854 of 2018(2) dt.13-12-2018 2/2 informant side at the instance of the petitioner. Considering the totality of facts situation discussed hereinabove, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Khagaria, in connection with Morkahi P.S. Case No. 97 of 2016 subject to the condition as laid down under section 438(2) of the Cr.P.C.
