====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-01-2023 Heard the learned counsel for the petitioner and the learned A.P.P. for the State. The petitioner seeks regular bail in connection with Bhabua P.S. Case No. 467 of 2022 for the offence registered under Sections 420 and 406 of the Indian Penal Code.
It is the allegation of the informant that the petitioner used to drive the Scorpio vehicle of the informant as a driver, which was registered in the name of the deceased husband of the informant, however, subsequently the petitioner had got the vehicle registered in his name fraudulently and when the informant used to ask him for the registration documents and the vehicle,
Patna High Court CR. MISC. No.56709 of 2022(3) dt.16-01-2023 2/3 he used to say that he had been given the said vehicle by her husband.
The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case, is having a clean antecedent and he is languishing in custody since 25.08.2022. The learned counsel for the petitioner has further submitted that the registration made in favour of the petitioner has already been cancelled by the District Transport Officer, Kaimur and the vehicle has already been released in favour of the informant.
Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also relying on the averments made by the petitioner to the effect that the registration made in favour of the petitioner qua the vehicle in question has already stood cancelled
Patna High Court CR. MISC. No.56709 of 2022(3) dt.16-01-2023 3/3 and the vehicle in question has also been released in favour of the informant by the police, I deem it fit and proper to admit the petitioner to the privilege of bail.
Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 467 of 2022.
