1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 427, 385, 387, 504, 506 and 34 of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that 14 accused persons including the petitioners came and objected the construction of

No.59719 of 2025(2) dt.11-09-2025 2/3 the house being made by the informant, on the ground that the land belongs to them, on protest, Anuj assaulted the informant by Lathi, Danda and brick, while Phulwa Devi and Lalmuni Devi dashed her on the ground, further Chhotu tore her Sari, it is next alleged that when her husband came to save her, all the accused persons assaulted him with bricks while Ranjay took Rs.40,000/- from his pocket and Sanni took five bags of cement.
4. The learned counsel for the petitioners next submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to land, the occurrence is alleged to have taken place. It is next submitted that no specific allegation of assault is alleged against the petitioners except Anuj who is alleged to have assaulted the informant by lathi, danda and bricks, but then it is submitted that informant never got himself treated. It is next submitted that entire family members have been implicated. It is also submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence. It is next submitted that Lalmuni Devi along with five others had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 54834 of 2025 and the
Patna High Court CR. MISC. No.59719 of 2025(2) dt.11-09-2025 3/3 same was allowed by an order dated 03.09.2025.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by learned counsel for the petitioners, let petitioners, above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Barachatti P.S. Case No. 951 of 2023, subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly, the instant anticipatory bail application stands allowed.
