2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352 and 3(5) of the BNS.

The learned counsel for the petitioners submit that petitioner no. 1 has antecedent of one case and petitioner no. 2 is a person with clean antecedent and the informant alleges that accused persons came and Pratima Devi assaulted her husband by knife causing injury while he was taking bath while Munna and Satya had caught his hand.

4. The learned counsel for the petitioners submit that

It is next submitted that though the informant alleges that Pratima Devi assaulted her husband by knife causing injury but then from perusal of the order impugned, it would manifest that the nature of injury was lacerated wound. It is next submitted had Pratima Devi assaulted her husband by knife in that event the injuries caused would have been an incised would. It is also submitted that Title Partition Suit No. 241 of 2019 is pending adjudication between the petitioner no. 1 and husband of the informant and they are agnates and on account of dispute relating to property, the present false case came to be instituted where both sides had assaulted each other.

5. Learned A.P.P. and learned counsel for the informant opposes the anticipatory bail application but they are not in a position to rebut the submission of the learned counsel for the petitioner that the wound inflicted on the husband of the informant is lacerated and not incised.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten

Patna High Court CR. MISC. No.54484 of 2025(2) dt.25-08-2025 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of the learned in connection with Gaurichak P. S. Case No. 188 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
