JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being mother in law of the victim is languishing in jail custody since 27.06.2015 in a case registered for the offences punishable under Sections 498A, 323, 344/34 of the Indian Penal Code.

The accusation against the petitioner and co-accused, who happens to be husband of the victim, is that they confined the victim in their house by tying her hands and legs with iron beri. The impugned order does not show as to whether the victim sustained any injury or the said iron beri was seized by the police or not.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri N.P. Singh, Judicial Magistrate 1st Class, Sherghati, in connection with Barachatti P.S. Case No. 256 of 2015.
