The petitioner seeks bail in connection with Konch P.S. Case No. 224 of 2013 dated 17.07.2013 instituted for the offences under Sections 147, 148, 149, 341, 323, 324 and 427 of the Indian Penal Code, Section 27 of the Arms Act, Sections 3/4 of the Explosive Substances Act and Section 17 of the C.L.A. Act. The FIR has been registered against unknown with the allegation that mistakenly, a vehicle being plied on Gaya-Goh road was taken to be a police vehicle, and a bomb was hurled on it which led to the damage of the said vehicle. The occupants of the vehicle were also injured. The local police was of the view that the occurrence has been committed by some banned organization. Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.50708 of 2017 (3) dt.08-12-2017 he has been made accused in this case because of local politics. Earlier, the petitioner had been implicated in Goh P.S. Case No. 140 of 2013 which was registered on the same day for an occurrence which has been committed also on the same day. Learned counsel for the petitioner submits that he cannot be expected to be present at two places for committing such occurrences. In the aforesaid case referred to above viz. Goh P.S. Case No. 140 of 2013, he has been acquitted.

The petitioner stands remanded in this case on 10.07.2017. With respect to the other cases about which reference has been made in para-3 of the petition, it has been submitted that the petitioner is on bail in those cases.

In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Gaya in connection with Konch P.S. Case No. 224 of 2013.
