Mr.Rajesh Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-08-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 341/323/498A/506/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Petitioner is husband of the informant of the case registered under Section 498A of the Indian Penal Code. Petitioner is in custody since 04.06.2019.

After taking instruction from the petitioner learned counsel for the petitioner submits that the petitioner is ready to pay Rs.6,000/- (Six thousand) per month for maintenance to the wife and the minor child residing with the wife. The

Patna High Court CR. MISC. No.52816 of 2019(2) dt.29-08-2019 2/2 amount would be subject to the final outcome of the appropriate proceeding of maintenance and matrimonial dispute. The petitioner shall deposit Rs.6,000/- (Six thousand) every month in the account of the informant and shall produce a receipt of the same before the Court-below every month. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chapra Mahila P.S. Case No.20 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
