The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 307, 341, 323, 325, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, it is stated by the informant that the accused persons including Ajit Kumar and the petitioner herein started to assault Chandradeo Ram. As a result of assault by Ajit Kumar, Chandradeo Ram sustained several injuries and he fell down unconscious. Others were also attacked. It is further stated that on being taken to the hospital he died.
It is submitted by learned counsel for the petitioner that from perusal of the FIR it would transpire that the main allegation of assault is on co-accused Ajit Kumar. The allegation on petitioner and others are general and omnibus in nature. Further Ajit Kumar has been enlarged on bail vide order dated 25.8.2021 (Annexure-4). The
Patna High Court CR. MISC. No.67308 of 2021(2) dt.26-04-2022 2/2 petitioner is in custody since10.9.2021. Further referring to the order of the learned trial court rejecting the application for bail of the petitioner, it is submitted that the postmortem report gives the cause of death to be sudden cardiac failure because of the injury on the body of the deceased.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the nature of allegation against the petitioner being general and omnibus, grant of bail to coaccused Ajit Kumar vide order dated 25.8.2021 and the petitioner having remained in custody for 7 months, the petitioner is directed to be enlarged on bail in connection with Aurangabad Muffasil P.S. Case no. 84 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad.
