For the Petitioner/s : Mr Mritunjay Kumar, Advocate For the Opposite Party/s : Smt Indu Kumari Srivastava, APP ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 04-10-2016 The petitioner apprehends arrest in Mahesh Khunt Police Station (PS) Case No 30 of 2016 dated 05.04.2016, GR No 721 of 2016 instituted under Sections 363, 366A/34 of Indian Penal Code (IPC).

The allegation is that the informant's minor daughter, aged about 14 years, had gone to School and is traceless. He suspected the petitioner and one Mithun Kumar who have kidnapped the daughter. Case diary was called for. The learned Sessions Judge had also perused the case diary but regrettably, apart from saying that there is material therein, he has said nothing further as to what was the material.

After perusing the case diary, learned APP points out that there is allegation that Mithun Kumar took away the daughter

Patna High Court Cr.Misc. No.30919 of 2016 (3) dt.04-10-2016 2/2 of the informant to marry with her. It is suspected that the petitioner helped. It is, thus, clear that there is no one, who has seen petitioner involved in any manner.

Be that as it may, in the event of his arrest or surrender within five weeks from today, the petitioner abovenamed shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Mahesh Khunt PS Case No 30 of 2016 dated 05.04.2016, GR No 721 of 2016 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
