Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends her arrest for the offences alleged under Sections 341, 323, 307, 109, 354, 448, 506 and 504 of the Indian Penal Code, registered in connection with Athmalgola P.S.Case No. 176 of 2020.
As per the allegation, the accused persons were forcibly dragging one Arjun Pandey, whereupon the informant and her family members intervened and prohibited them. The accused persons entered into the house and co-accused Rohit Pandey and Shubham Pandey assaulted the mother of the informant and they also abused the family members. The learned counsel for the petitioner has submitted that the petitioner is a lady. Although she was previously
Patna High Court CR. MISC. No.66154 of 2021(2) dt.21-07-2022 2/2 implicated in Athmalgola P.S.Case No. 175 of 2020, but in that case the police submitted final form against her. Considering the above facts and circumstances, let the petitioner above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Athmalgola P.S.case No. 176 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
