30-08-2016 Heard Sri Naresh Dikshit, learned counsel, who was assisted by Sri Lalan Kumar, learned counsel for the petitioner and Sri Ajay Kumar, learned Addl. Public Prosecutor. The sole petitioner, who is named in the F.I.R. with specific accusation apprehends his arrest in Lakhisarai P.S. Case No. 205 of 2016 registered for offence under Sections 302, 120(B) & 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that since father of the petitioner had appeared in a case, in which some of the persons were named accused, the petitioner has falsely been implicated. It has also been argued that though father of the
Patna High Court Cr.Misc. No.31957 of 2016 (2) dt.30-08-2016 2/2 petitioner, who is a practicing lawyer, was made accused, he has been extended the privilege of anticipatory bail. Accordingly, a prayer is being made to extend the same privilege to the petitioner. However, after going through the F.I.R., in which there is specific accusation against the petitioner in a case registered for offence under Section 302 & other allied sections of the Indian Penal Code, the Court considers that it is not a case for grant of anticipatory bail.
The petition stands dismissed.
