Earlier also when this case was listed on 10.04.2015, no one had appeared on behalf of the petitioner and the Court, while adjourning the matter, had given last indulgence to the learned counsel for the petitioner.
Having regard to the nature of allegation for offence under Sections 406, 420 and 506 of the Indian Penal Code and that the allegation against the petitioner is that he has pocketed Rs. 19.50 lacs given to him for transfer of land by the Opposite Party No. 2 and the sale deed was also not executed by the petitioner in favour of the Opposite Party No. 2, it would become very clear
Patna High Court Cr.Misc. No.45073 of 2014 (5) dt.07-05-2015 2/2 that after the petitioner has obtained the interim relief on 18.12.2014 as with regard to no coercive steps being taken against him, his learned counsel has choosen to remain absent that the petitioner can continue with interim relief for an indefinite period. Such repeated absence of learned counsel for the petitioner, therefore, being deliberate, this application is fit to be dismissed. It is, accordingly, dismissed.
