JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case was lodged on the basis of complaint petition filed by the complainant/informant and in the aforesaid complaint petition, the complainant/informant leveled allegation against the petitioner that the petitioner took the victim and after that victim did not return.

In course of investigation, at least, this fact came to light that victim had solemnized his marriage with one Tahera Khatoon @ Rozi, who happened to be sister-in-law of the petitioner, and after solemnization of marriage, the victim and Tahera Khatoon @ Rozi were missing. It appears that police could not succeed to trace out the victim as well as said Tahera Khatoon

Patna High Court Cr.Misc. No.44651 of 2015 (3) dt.25-01-2016 2/2 @ Rozi and without tracing out the aforesaid persons, police submitted charge sheet against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Pakaribarawan P.S.Case No. 13 of 2013, G.R.
