====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Belsand P.S. Case No. 107 of 2014 registered for the offence under Sections 363, 366 and 366(A) of Indian Penal Code. Learned counsel for the petitioner submits that admittedly it is a case where the boy and girl have eloped and now the girl has also been blessed with a child. It is further submitted that the victim girl in her statement under Section 164 of Cr.P.C. has categorically stated her age as 20 years and the lower court has assessed her age as 18 years. Furthermore, the victim girl has stated that she has gone along with the petitioner out of her own sweet will.

Patna High Court Cr.Misc. No.28359 of 2016 (3) dt.09-09-2016 Under the facts and circumstances of the case and after considering the material available in the case diary, the above named petitioner in the event of his arrest/surrender within a period of four weeks from the date of receipt of copy of order shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R. K. Sinha, the learned Judicial Magistrate-1st Class, Sitamarhi, in connection with Belsand P.S. Case No. 107 of 2014, subject to condition as laid down under Section 438 (2) of Cr.P.C.
