2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 8(b), 18, 29 of the NDPS Act.

3. Petitioner is alleged to be indulged in illegal cultivation of opium.

4. It is submitted that petitioner has been made accused in this case only on suspicion. The land on which the alleged cultivation of opium crops was found doest not belong to this petitioner. In the F.I.R, there is no description of land upon which cultivation of opium was found. Petitioner claims

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Sessions Judge-Cum-Spl. Judge , N . D. P . S. Act, Gaya in connection with Barachatti P.S. case no. 51 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
