Bela Singh, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition, so far as petitioner no. 2 (Kaleshwar Paswan) is concerned.

Permission is accorded. The anticipatory bail petition, in respect of petitioner no. 2, stands dismissed as withdrawn.

Sole petitioner (i.e. petitioner no.1) apprehends his arrest in a case registered for the offence under Sections 147, 149, 353, 414 of the I.P.C. and Sections 30(a), 37(c) of Bihar Prohibition and Excise Act.

5.750 liters of foreign liquor has been recovered from godown of co-accused Kaleshwar Paswan.

Patna High Court CR. MISC. No.56523 of 2022(2) dt.02-12-2022 2/2 It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of petitioner and he has got no concern with the alleged recovery. Petitioner has got clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let petitioner namely Jageshwar Sahni, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court-II, Muzaffarpur in connection with Kudhani P.S. Case No. 129 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
